OVERVIEW

Following the success of 2 annual editions of the ‘Developments in International Arbitration’ seminar in Dubai, Beirut and one to take place in Saudi Arabia in November 2022, LexisNexis Middle East and SOL International are pleased to invite you to join us for the 3rd Dubai edition to be held on 29th November 2022.

Internationally renowned arbitrator and special guest speaker, Gary Born, will return to provide his valuable knowledge and insight for this seminar. Gary Born is the Chair of the International Arbitration Practice Group at Wilmer Cutler Pickering Hale and Dorr LLP, and one of the world’s preeminent authorities on international commercial arbitration and international litigation.

The seminar will kick off with a welcome address by LexisNexis Middle East and a keynote speech followed by a panel discussion, where Gary Born will be joined by Anne Hoffmann, internationally recognised commercial and investment arbitrator, Hasan Arab, Partner and Regional Head of Dispute Resolution of Al Tamimi & Company, and Fatima Balfaqeeh, Founder and Managing Director of RKAH Consultancy Firm to discuss recent developments in International Commercial Arbitration globally and to address the latest developments in the UAE and MENA region.

The panel discussion will be moderated by Sarah Malik of SOL International Ltd.

SPEAKERS

Gary Born

Chair of the International Arbitration Practice Group, Wilmer Cutler Pickering Hale and Dorr LLP

Gary Born, Chair of the International Arbitration Practice Group at Wilmer Cutler Pickering Hale and Dorr LLP, is one of the world’s preeminent authorities on international commercial arbitration and international litigation. He has served as counsel in over 650 arbitrations, including several of the most prominent arbitrations in ICC and ad hoc history. He has sat as an arbitrator in over 200 institutional and ad hoc arbitrations. Mr Born is President of the Singapore International Arbitration Centre (SIAC) Court of Arbitration and serves in an advisory capacity in other institutions worldwide. He is a member of the American Law Institute and of the Board of Trustees of the British Institute for International and Comparative Law. He has served on the Executive Council of the American Society of International Law, the Advisory Committee of the ALI’s Restatement of US International Arbitration Law, the Advisory Committee of the ALI Restatement of US Foreign Relation Law (Fourth) and as co-chair of the ABA International Section, Committee on International Aspects of Litigation.

Sarah Malik

CEO of SOL International and International Disputes Counsel

Sarah Malik is an award-winning lawyer who achieved Litigator of the Year (2022) at the first GCC Women in Law Awards and received an honourable mention in the ‘Law Firm Leader of the Year’ category at the same awards.

In March 2022, SOL was named by Legal 500 EMEA as a ‘Firm to Watch in Dispute Resolution: Arbitration and International Litigation’. Sarah and SOL have been further nominated as Women Lawyer of the Year and Rising Law Firm of the Year. She is a member of the SIAC Users Council in the Middle East and is appointed to the Lagos Panel of Arbitration Neutrals. Sarah is a Fellow of the Chartered Institute of Arbitrators and accepts appointments to sit as an Arbitrator. She undertakes international commercial arbitrations as Counsel (DIAC, ADCCAC, DIFC-LCIA, ICC) and practices commercial litigation at the DIFC and ADGM Courts.

At the end of 2019, she authored “A Guide to GCC Arbitration”, published by LexisNexis and in 2018, she authored “The UAE Chapter on Arbitration in the International Comparative Legal Guide”. Sarah is regularly invited to speak worldwide on arbitration, including for the ICC, CIArb and IBA.

 

Hasan Arab

Partner and Regional Head of Dispute Resolution, Al Tamimi & Company

Dr Hassan Arab is a leading dispute resolution expert in the UAE and the broader Middle East with full rights of audience before all courts in the UAE. He regularly sits as an arbitrator and is called upon to provide legal expert opinions before arbitral tribunals and foreign courts.

He is the Chair of the Steering Committee of the ICC – UAE Commission on Arbitration & ADR and a member of several International Arbitration Institutions such as the ICC International Court of Arbitration; Advisory Council Asian International Arbitration Centre (AIAC); The future Arbitration Court of the Casablanca International Mediation & Arbitration Centre (CIMAC); Shanghai Arbitration Commission (SHAC) and Board Advisor of Delos Dispute Resolution etc.); Former DIAC Board of Trustees; Former DIFC Court User’s Committee.

Dr Arab has authored several publications on Arbitration and Dispute Resolution, including a book on the Civil Procedures Law in the UAE, Guide to Arbitration in the UAE and the Summaries of UAE Courts’ Decisions on Arbitration. In addition, he has written and lectured extensively on various topics, which include Arbitration, Dispute Resolution, Enforcement of Judgments, Specialised Court and Committees in the UAE.

Anne Hoffmann

Commercial and Investment Arbitrator

Anne K. Hoffmann is an internationally recognised arbitration practitioner with more than two decades of experience in international commercial and investment arbitration. She acted in arbitrations seated around the globe and governed by a great variety of laws. She is dual qualified in Germany and England & Wales and practised at leading international law firms in London, Geneva and Dubai before focusing on her practice as an independent arbitrator.

To date, Anne has acted as sole arbitrator, co-arbitrator and chair in commercial arbitrations, both institutional under all significant rules (including ICC, LCIA, Swiss Rules, DIFC-LCIA, SIAC, HKIAC, SCC, VIAC, DIAC, CRCICA and DIS) as well as ad hoc, including UNCITRAL. She has also been appointed in investment arbitration proceedings, including under the ICSID Rules.

Anne conducts arbitrations in English and German and has good knowledge of French and Russian.

In addition to her membership in various arbitration organisations, Anne is on the panel of arbitrators of SIAC, HKIAC, KCAB and AIAC. She is also a member of the SIAC Users Council.

Anne regularly speaks and publishes on topics of international arbitration.

She has been recognised as a Global Leader in Arbitration in all editions of Who is Who Legal since 2014 and is listed by Chambers Global as the “Most in Demand Arbitrator” based in the UAE.

Anne was also a visiting lecturer at Humboldt University Berlin.

Fatima Balfaqeeh

Founder and Managing Director, RKAH Consultancy Firm

Fatima Balfaqeeh is a Legal Counsel, independent Arbitrator, Mediator, and Business Consultant.

Her career began two decades ago in government and semi-government entities in Abu Dhabi, leading contracts and procurement functions. She has worked extensively within commercial, legal and operational matters across various sectors, including construction-related fields, governance enforcement in contracts and procurement, project-related finance, payables, and banking credit facilities for corporate clients.

In 2018, Fatima launched her consultancy. She is a member of the Chartered Institute of Arbitrators (CIArb), RICS as a chartered Facilities Management Surveyor, and a Fellow of the Chartered Institute of Procurement and Supply Chain (CIPS). She also is a board member of the ICC-UAE, the Vice Chair of the ICC UAE’s Commission on Arbitration & ADR Steering Committee, and a board member on the MENA advisory panel (MAP) of the Royal Institute of Chartered Surveyors (RICS).
