Kuwait: Right to View Law Vote Soon

The Chairman of the Legislative Committee of Kuwait’s National Assembly has announced MPs will be voting on the draft right to view law next week. They said the law will enable nationals and residents as well as local and civil companies to view all information transparently. Some information like military and security matters will remain classified. The law has been thoroughly discussed with the Justice Minister, Waqf and Islamic Affairs Minister as well as other relevant departments.

According to local newspaper reports, Kuwait’s Commerce and Industry Minister has issued a Decision establishing an Independent Insurance Unit. It will have seven members, two of which will be full-time and have been appointed by Emiri Decree. It will regulate insurance businesses in the country in line with Article 10 of Kuwait Law No. 125/2019. Among other things, the committee will oversee the sector’s development and supervise it. They will be able to ask experts and consultants it considers appropriate to assist it and they will also be able to establish temporary advisory committees to study a specific topic within their remit.

Five Kuwaiti MPs have submitted a draft law to amend the criminal law to allow women, mothers, wives, or second removed female relatives to authorise medical treatment of children or husbands. They stressed this amendment will help to tackle various situations in which there is no next of kin such as the father or the grandfather to give the necessary permissions. The MPS proposed amending Kuwait Law No. 16/1960 on the criminal law to allow women to authorise medical tests and procedures for underage children and adults who don’t have the legal capacity to give permission.

Five Kuwaiti MPs have proposed amending the procedural law by adding new articles to the Civil and Commercial Law issued by Kuwait Decree-Law No 38/1980. The MPs want to make changes to regulate disputes involving judges and members of the public prosecution office by adding a new chapter. The aim is to set the situations in which a judge or a member of the prosecution office can be disputed and the deadlines to be met.

The Rapporteur of the Educational Affairs Committee of Kuwait’s National Assembly has announced the Committee has discussed amendments to the Audiovisual and Publication Laws. The amendments being considered relate to the penalties under both laws. If they are approved, those who violate either law will not be jailed. The Committee also discussed a draft law on media protections for young people and is waiting to get feedback on the Government.

According to local newspaper reports, Kuwait’s Social Affairs Minister has presented a draft law to allow the children of Kuwaiti female nationals and non-Kuwaiti men to receive social assistance. It has been referred to the Fatwa and Legislation Department to consider. The aim is to improve their living conditions and create a more equal system.

Kuwait: Amendment to Buildings Charter Proposed

A member of the Kuwaiti municipality council has submitted a proposal to add a new article to the buildings charter. If approved, public departments and private entities will have to build nurseries for the children of their staff. The aim is to ensure entities with more than 50 female employees or more than 200 employees, from both genders, have dedicated nurseries. The member added Article 25 of the Labour Law provides for establishing nurseries in these entities but has so far not been implemented.

Asil Almazid, spokesperson and director of the Public Relations and Media Department in the Authority for Manpower of Kuwait, has announced Circular 26/2019 on giving business owners two months from the date of issuance of work permits to pay the salaries of the workers. Businesses should transfer the wages via bank transfers to local finance companies for their workers who have been recruited from abroad. Almazil has said the Labour Inspection Department is conducting an inspection to make sure that this deadline is being respected.

Oman Joins Multilateral Convention on Mutual Administrative Assistance in Tax Matters

Oman has signed the Multilateral Convention on Mutual Administrative Assistance in Tax Matters. It aims to tackle offshore tax evasion and avoidance. It provides for all forms of administrative assistance in tax matters: exchanges of information on request, spontaneous exchange, automatic exchange, tax examinations abroad, simultaneous tax examinations and assistance in tax collection. It also guarantees extensive safeguards for protecting taxpayers’ rights. The Sultanate also signed the Common Reporting Standard Multilateral Competent Authority Agreement.
