UAE: Fines Announced for Private Companies That Fail to Meet Emiratisation Target

Khaleej Times, 7 February 2023: Firms which do not achieve the one per cent Emiratisation target by 1 July 2023 will be fined 7,000 AED for each UAE national who has not been hired.

Firms are now required to increase the number of Emirati employees in skilled roles by one per cent every six months.

Based on the amended scheme, penalties for private companies that fail to meet Emiratisation targets will now be imposed semi-annually.

Non-compliant companies will be charged starting from 1 July 2023. Penalties for non-compliance in 2022 will also continue to be collected.

The overall two percent target must be reached by the end of the year.

The amendments do not include any additional requirements or penalties.

Saudi Arabia: Electronic System to Collect Government Revenue Adopted

Almadina, 6 February 2023: Saudi Arabia’s National Centre for Government Enterprise Resources Planning Systems has adopted an electronic system to collect state revenue generated by government authorities.

The system has been launched by the Centre and the Finance Ministry. It will support digital transformation projects in the centre in order to achieve the 2030 Vision objectives.

The centre’s role includes offering solutions and integrated systems to increase the quality of electronic services for government financial transactions.

Qatar: Shura Council Approves Draft Law Amending Real Estate Law

The Peninsula, 6 February 2023: Qatar’s Shura Council has held its regular weekly session, where it approved a draft law amending some provisions of Qatar Law No. 6/2014 Regulating Real Estate Development.

This has been approved after the Legal and Legislative Affairs Committee’s report was reviewed. Its provisions have also been discussed by the Council.

The amendments have included several definitions contained in the draft, the establishment of a special register for those licensed to practice real estate development, and another register for those licensed to practice the profession.

The amendments have also defined the obligations of real estate developers.

The draft regulates the relationship between developers and banks.

It stipulates the opening of an account by agreement between both parties, in which the rights and obligations of both are to be determined.

The amendments also include asking developers to submit an accounting statement detailing the amounts spent on the project.

It has grants judicial authority to the Real Estate Regulatory Authority’s employees and establishes a licensing committee.

The Committee will be entrusted with issuing licenses to real estate developers and companies which operate in the field by managing and maintaining real estate which is under construction.

The Council has also approved a draft law amending some provisions of Qatar Law No. 24/2006 on issuing the Law of Fertilizers and Agricultural Soil Improvers in GCC countries.

This had been referred to the Council by the government, after reviewing the Services and Public Utilities Committee’ report.

In addition, they have also approved a request to extend the work of the Cultural Affairs and Information Committee to study a draft law on documents and archives.

The Council’s Speaker briefed members on a submitted proposal to include an emergency clause on criminalizing contempt for religions and spreading hatred among people.

The proposal has called for the promotion of values like coexistence, tolerance, international peace and security.

It will be on the agenda of the 146th General Assembly of the Inter-Parliamentary Union, which will be held next March.

Oman: New Regulation Issued For SME Registration

Atheer, 5 February 2023: The Chairwoman of Oman’s Small and Medium Enterprises (SMEs) Authority has issued Oman Decision No. 56/2023 on issuing regulations to register SMEs and on issuing business entrepreneurs’ identity documents.

Based on this decision, SME owners must correct their position to align with the regulations’ provisions. This must be done within 90 days following the date the regulations come into force.

Headquarters must also be within the geographical borders of Oman.

Entrepreneur cards can be obtained if the owner is fully committed to the project. However, they must also be registered with the Labour Ministry as the business owner.

Kuwait: Municipality Law Amended

Alqabas, 4 February 2023: Kuwait’s Municipality has planned to increase punishments and penalties imposed on property owners who violate the Building Code by transferring their private housing into an investment property.

Based on these amendments, property owners, engineering offices, consultancy firms, engineers, or contractors who violate the building code will be fined a minimum of 100 Dinars up to 5,000 Dinars.

In all cases, the offenders must correct the violation at their own expense. In addition, the power supply will also be cut from non-compliant buildings.

Saudi Arabia: Implementation of Government Rental of Real Estate to Start Soon

Almadina, 29 January 2023: The Saudi General Authority for State Real Estate has clarified that the state’s real estate rental law and its implementing regulations will come into force starting from 2 February 2023.

The law was approved, and 180 days have passed since its publication in the Umm Al-Qura newspaper, so it must be implemented.

The new law and its implementing regulations have replaced the “state leasing and eviction of real estate” law and its implementing regulations.

It aims to regulate the state’s real estate leasing through government agencies according to its needs. It also rationalises the financial costs of renting and optimises using real estate properties leased by government agencies.

Qatar: Health Insurance Law to Be Applied to Visitors

Alsharq, 28 January 2023: The Qatari Public Health Ministry has started the first phase of the Health Insurance Law implementation in Qatar Law No. 22/2021, covered by Qatar Ministerial Decision No. 17/2022.

This decision states that a health insurance policy must cover visitors to Qatar.

The ministry has said that the required health insurance policy must only cover basic health care needs such as A&E treatment.

The compulsory policy must be purchased for a single visa for 30 days at the cost of 50 Riyals when it is first issued and every time the visa is renewed.

Visitors can choose one of the registered companies to provide them this service by visiting the Ministry website.

Oman: Law Concerning Job Performance Adequacy Measuring

Atheer, 29 January 2023: Oman Ministerial Decision No. 36/2023 on issuing the law for measuring the adequacy of job performance has been issued.

The decision defines adequacy as the total and final level of the employee’s performance in achieving their primary objectives and outcomes based on designated levels. These levels include excellent, very good, good, acceptable, or weak. There is also a level of acceptable or weak due to illness.

This decision applies to all civil service departments employees and others who have legal personalities who have been in service for six months or more.

Kuwait: Action to be Taken Against Some Doctors

Kuwait Times, 30 January 2023: The Kuwait Ministry of Health is to take disciplinary action against doctors who have conducted medical examinations and x-rays on expatriates without charging the necessary fees.

These fees are usually collected by health staff before the treatment is given. However, it was found some doctors had let relatives and friends who were expats use these services without charging them. Steps taken would include referring these doctors to an investigation at the ministry or referring them to the Public Prosecution in the case of repeat offences.
