UAE: New Freelance Work Permits for ‘All Skill Levels’ to be Introduced

The UAE plans to introduce a flexible work permit by the third quarter of 2023, enabling individuals of all skill levels to take up freelance jobs either in the country or from anywhere in the world.

The Minister of Human Resources and Emiratisation confirmed the new permit aims to support all types of remote and flexible work and expects it to create up to 24,000 jobs by 2024.

The permit would allow employees to work for themselves, enhancing productivity in the workforce while allowing businesses to attract a more diverse pool of talent.

Nearly one year after the UAE first announced its intention to introduce corporate income tax, the Federal Decree-Law No. 47/2022 On the Taxation of Corporations and Businesses has been published. Thomas Vanhee from Aurifer Middle East Tax provides an explanation of what we can expect from the new tax system.


The more the merrier? What are the advantages and disadvantages of creating a tax group in the UAE Corporate Income Tax context?

UAE: Public Prosecution Warns of Penalties Against Employees Who Leak Details of Investigations

Khaleej Times, 3 March 2023: The UAE’s Public Prosecution has warned disclosing information from legal cases is a crime punishable by stiff penalties.

In an advisory, the authority has reminded all details related to investigations and ensuing findings must be kept strictly confidential, and hefty penalties will be imposed on violators.

This applies to all those who may be privy to matters in court, including public prosecution staff, clerks, assistants, and experts.

The authority also stated evidence collection reports must be treated with the same confidentiality stipulated in a subclause of Article 67 of Federal Decree-Law No. 38/2022 On the Issuance of the Criminal Procedure Law.

Saudi Arabia: Health and Justice Ministries Sign Memorandum of Understanding

5 March 2023: According to the Saudi Press Agency, Saudi Arabia’s Health Ministry and Justice Ministry have signed a memorandum of understanding to implement reconciliation in cases related to medical errors and associated complaints, before they are referred to the judiciary.

This decision comes after the jurisdiction for considering medical mistake claims was transferred from the Health Ministry to the Justice Ministry.

The goal of the transfer is to improve patient safety and protect their rights.

This initiative also aligns with the establishment of the Patient Safety Centre and the expansion of insurance coverage for medical errors.

Qatar: Decision to Regulate Subsidized Construction Materials Suspended

Alqabas, 5 March 2023: Qatar’s Trade and Industry Minister has suspended the implementation of Qatar Ministerial Decision No. 30/2023, which regulates subsidized construction materials, for further examination.

According to sources, the decision has been suspended to review and make amendments which will protect the interests of nationals who benefit from the subsidized materials to construct their homes.

As a result, the mechanism for dispensing construction materials to nationals will remain the same as it was before the decision was made.

Oman: Draft Labour Law Referred to State Council by Majlis A’Shura

Muscat Daily, 1 March 2023: The Majlis A’Shura has referred the Draft Labour Law, which was proposed by the government, with amendments to Oman’s State Council.

This aims to complete the legislative cycle according to Article 49 of Oman Council of Oman Law.

During the session, the shura discussed the report of the draft law which contained amendments and additions to some articles to ensure workers’ rights.

Kuwait: New Decision Requires Pharmacies to Restrict Payments to Prevent Money Laundering

Arab Times, 5 March 2023: A new ministerial decision has been issued by Mazen Al-Nahedh, the Minister of Trade and Industry, to prevent money laundering activities.

Private pharmacies and other entities operating in the drug control sector are required to limit the use of “Knet” as a means of payment to amounts exceeding 10 dinars.

Cash payments for any sale are also limited to amounts below 10 dinars.

Any violation of this decision may result in the imposition of penalties and measures in accordance with relevant laws and decisions by the supervisory authority.

Abu Dhabi: Previous Pension Service Periods Added Automatically

Albayan, 5 March 2023: The Abu Dhabi Pension Fund has confirmed it automatically includes the previous service periods of individuals who are registered with the Fund from both the private and public sectors.

This is done at no additional cost to the insured persons.

However, if an insured person has received their end of service payment and later decides to add their previous service period, they must pay a fee which is equivalent to 26 per cent of the salary used as the basis for calculating their subscriptions.

The service periods which can be added include previous work periods with the federal government, previous work periods in the private and public sectors in the Emirate of Abu Dhabi, previous work periods in the private sector outside the Emirate of Abu Dhabi, and previous service in local authorities in the UAE, provided the conditions stipulated by law are met.

UAE

UAE: Unemployment Insurance Cannot Be Transferred to Others

Emaratalyoum, 24 February 2023: Insurance companies working with the UAE’s Human Resources and Emiratization Ministry have been receiving compulsory insurance requests for unemployment insurance from employees in both the private and public sectors.

Failure to obtain this insurance could result in a fine of up to 400 AED.

This type of insurance was mandated by Federal Decree-Law No. 13/2022 Concerning Unemployment Insurance to provide employees with a three-month income equivalent to 60 per cent of their salary value if they leave work for reasons beyond their control or non-disciplinary reasons.

The insurance cannot be assigned to others or transferred to any other individual or company at any time.
